What to do? According a recently released report by the non-partisan (cough cough) Congressional Research Service, Trump can build the fence / wall without declaring an emergency.
“A rarely mentioned alternative, one not subject to the kind of legal analysis as an action under the NEA, would be for the president to act under several existing statutes — a move which would not be subject to the NEA's congressional termination provision since it does not require a declaration of any emergency,” said Banzhaf’s analysis."
This basically means Trump can invoke national security, instead of a national emergency, then instruct the Secretary of Defense to use military money and manpower, or employ civilian contractors, to build the fence / wall. But it appears there are strict spending caps, and tight definitions on where this construction can occur.
