Africa has a 'high court?' So what good is it on a continent mired in wars, famine, disease, corruption - and a thriving slave trade - in plethora of failed states run by jihadists, marxists, and bloody dictators?

I think a hint about the court's impotence and irrelevance might be contained in the court's name, which offers a distinction without a difference.

Florida House OKs bill Ending Union Dues Pay Deductions

With the usual democrat lackeys blathering on about 'union busting and class warfare.'

"In a blow to public employee unions, the Republican-controlled Florida House passed a bill Friday that would ban payroll deductions of dues and require labor organizations to get individual members' OK before using their payments for political purposes.

The Florida legislation, which still needs Senate approval, is part of a Republican push in several states to curtail the power of public-sector unions that generally support Democratic candidates. The efforts follow GOP election gains in November."

A "blow to public unions?" "Curtail the power of public unions??" Yes. It's such a tragedy when one cannot require other people to pay for funneling money into your bank account. It's almost barbaric.

The entitlement whining continues from the democrat lackeys who directly benefit from the campaign donations of these public sector unionists:

"Democrats responded that the legislation is about union-busting, class warfare and winning elections. "What's the real reason for this bill?" asked House Democratic Leader Ron Saunders of Key West. "Two words: political payback."

Union leaders pointed out that even the House staff analysis says the bill likely would make it more difficult for unions to collect dues for political and other purposes.

"The lawmakers who voted for this bill have signaled their desire to use the power of government to single out and attack the hard-working men and women who serve Florida in public employment," said Andy Ford, president of the Florida Education Association, the statewide teachers union. "It's simply un-American."

Ya'll hear dat? Un-American! How dare those mean ol' Republicans make us do our own collections and book keeping!  We had a sweet scam going on, and those mean ol' Republicans didn't wanna stay hood winked. Dag nabbit!

But, wait. There's more BHD; as in piled higher and deeper:

"Rich Templin, legislative and political director of the Florida AFL-CIO, said unions are unfairly being singled out because the legislation doesn't affect payroll deductions for about 300 other entities such as charities and insurance companies. Some of these groups make political contributions that dwarf those of organized labor, he said."

What Mr. Rich 'cognitive dissonance' Templin doesn't explain about his convoluted conglomeration of 'charities, insurance, and union dues' is that charities and insurance companies do not directly negotiate terms of employment contracts with the government for the benefit of union members, and these charities and insurance companies payments are not required by law to be deducted from the paychecks of public union employees.

It's a distinction with a huge difference, sparky.

In the final analysis, I think the real complaint is these unionists will have to actually do some work in order to receive their money.

As stated above, all this is nothing new for these Neo-Bolshevik thugs. In May last year, about 100 bussed-in SEIU thugs used 'we know where you live' intimidation tactics to trespass upon the private residence of Greg Baer, a senior Bank of America executive based in Washington, D.C.

Mr. Baer wasn't home that Sunday afternoon, but is terrified 14 y.o. son was, and called the police to disperse the gang of thugs.

Kansas & Missouri Ranked the Worst for Job Losses in February

"Kansas and Missouri ranked the worst among all states on employment losses in February, according to a U.S. Bureau of Labor Statistics report.

The report, issued Friday, said Kansas had a net decrease of 12,800 nonfarm payroll jobs, and Missouri lost 10,100 from January to February. Kansas also ranked worst in over-the-year percentage decrease in employment, losing 1 percent, the bureau said.

On the upside, the jobless rate in Kansas last month was 6.8 percent, considerably lower than the 9.4 percent in Missouri and the 8.9 percent that was the national average in February.

The bureau said there were about 108,600 jobless workers in Kansas in February, down from 111,800 in February 2010. In Missouri there were 297,600 unemployed workers in February, down from 315,700 a year earlier."

Government School Safety Drill with "Anti-Immigrant Shooter" Canceled

In Treynor, Iowa.

"Operation Closed Campus was designed to ensure school officials, emergency responders and support organizations are prepared in the event they face a school shooting, according to the Pottawattamie County Emergency Management Agency.

The agency, along with the Homeland Security Exercise and Evaluation Program, distributed an exercise plan Wednesday to detail exactly how the drill -- to be held at Treynor High School and involving roughly 300 people, local police, hospitals and the Red Cross -- would be carried out."

According to the exercise plan submitted by officials, the 'back story' for this 'safety drill' went like this:

"a white 18-year-old high school senior who “has been seen with anti-immigration demonstrators” and whose family “is known to be firearm enthusiasts, if not fanatics” starts a fight with a group of minority students “blurting racial slurs and that he is tired of them moving in and stealing jobs and money from Americans” then “pulls a handgun from his waistband, shooting one of the minority students.”

Parents sternly objected to the obvious inflammatory political overtones, and contacted the town's mayor,  the county board of supervisors, the Iowa legislature, and even the governor to voice their objections.

Doug Reed, the lead exercise planner for the county’s Emergency Management Agency said the 'back story' for this emergency scenario had “nothing to do" with the continued political debate over immigration laws.

Oh. Of course not. And we have no reason to doubt the uber-pure motives of our ruling class betters.

But, apparently, the 'white, anti-immigrant, firearm fanatic' back story had something to do with obtaining the federal funding from Homeland Security for this exercise.

 In a letter to the commission, Wampler said the motto has been posted in about 200 public buildings so far and in Missouri, most recently in Branson, Marshfield and Buffalo."

Florida Judge Defends Decision to Allow Sharia Law to Decide Civil Case

Arbitration agreements are nothing new in civil law. In fact, they're quite common; product disputes, labor relations and even pre-nups abound, and basically fall into two types: binding and non-binding. Religious arbitration of civil disputes has long been used by Christians and Jews, subject to secular court review.

From Wikipedia:

"Arbitration, a form of alternative dispute resolution (ADR), is a legal technique for the resolution of disputes outside the courts, where the parties to a dispute refer it to one or more persons (the "arbitrators", "arbiters" or "arbitral tribunal"), by whose decision (the "award") they agree to be bound. It is a settlement technique in which a third party reviews the case and imposes a decision that is legally binding for both sides."

 Last Tuesday, Florida Circuit Judge Richard Nielsen defended his decision to uphold a binding arbitration agreement, based upon Sharia Law, between ex-trustees of a local Mosque who claim to have been unfairly removed by the current leadership of that Mosque. The Islamic arbitration ruled in favor of the ex-trustees. The current leadership appealed, which is why the matter ended up before Judge Neilson:

"From the outset of learning of the purported arbitration award, the court's concern has been whether there were ecclesiastical principles for dispute resolution involved that would compel the court to adopt the arbitration decision without considering state law," Tuesday's opinion said.

"The court has concluded that as to the question of enforceability of the arbitrator's award the case should proceed under ecclesiastical Islamic law," the judge wrote.

The judge noted in his opinion that he must hear further testimony to determine whether "Islamic dispute resolution procedures have been followed in this matter."

Sounds fair and reasonable, and rather innocuous... if it was under anything other than Sharia law.

Why? Precedent. As in 'toe hold.' Courts love precedent.

Despite the revisionists and naysayers, centuries of Christian Philosophy in the West gave us legal concepts of private property rights and the rights of individuals. Sharia Law is antithetical to those concepts, especially in regards to women's rights and religious freedom. Sharia's logical outworking is to subvert the very society whose liberalism it cynically seeks to exploit.

It seems plausible to me that this whole case was contrived by the two Mulsim parties to test the boundaries of the 'church/state' concept in law, and whether their innocuous foray into a U.S. court would get any traction. It has, and I believe another case involving Sharia law will soon knock on another court's door, with another matter slightly more serious, seeking arbitration. Under Sharia, of course.

Creeping from the Magna Carta to Sharia Law: In 2008, Sharia courts were officially implemented in five Mosques in Britain to arbitrate civil matters under Sharia law. From the Times of London: 

"Sheikh Faiz-ul-Aqtab Siddiqi, whose Muslim Arbitration Tribunal runs the courts, said he had taken advantage of a clause in the Arbitration Act 1996.

Under the act, the sharia courts are classified as arbitration tribunals. The rulings of arbitration tribunals are binding in law, provided that both parties in the dispute agree to give it the power to rule on their case."

By 2009, there were 85 such 'courts' operating in Britain. They've ruled on civil matters from Muslim divorce and inheritance, to nuisance neighbors, to approval of polygamous marriage and enforcement of a woman's duty to have sex with her husband on his demand. These Sharia courts have also dealt with the criminal matter of domestic violence, while working in tandem with the police investigations.

And regardless of whether or not we Westerners misunderstand the nature or intent of Sharia law, these 'separate but equal' courts of Sharia law aggravate cultural discord, and discourage assimilation into the Western countries Muslims seek to immigrate.

Here in the U.S. of A., as a preemptive measure, 11 states - Arizona, Arkansas, Florida, Georgia, Mississippi, Missouri, South Carolina, Tennessee, Texas, and Wyoming - have introduced legislation to ban Sharia law as a basis for legal decisions. 

Oklahoma became the first state to ban Sharia from being considered in state courts when voters passed a similar ban last fall. That law is currently on hold by a federal court order.

NPR has a very interesting transcript of a conversation with David Yerushalmi (who wrote the policy paper that sparked the legislation in Tennessee and other states) and associate professor of Islamic and American Law at Boston College, Intisar Rabb, which offers insight to the trouble with Sharia and U.S. jurisprudence.

In the final analysis, the trouble will come down to the distinctions in religious arbitration. For years, Christians and Jews have utilized the process inside the office of lawyers and paralegals who act as a tribunal to mediate the dispute and make binding determinations, subject to secular court review.

This is distinct from what we see burgeoning throughout Britain; Muslims insisting upon their own network of opaque 'separate but equal' courts of Sharia law inside their Mosques.

*While there are many passages in Scripture which have dual meaning and illustrate the life of Christ, in particular, or mankind, in general, I do not believe this is one of those writings. There are simply too many personal pronouns used, plus the uncanny resemblance to the life, conviction, & death of Jesus Christ leaves me convinced this is a prophetic and vivid description of a Risen Savior.

CAIR Sought Qaddafi Millions

That would be the Council for American Islamic Relations, the uber-Taquiya organization which ostensibly lobbies Congress and the media in order to cultivate advantages and perceptions beneficial to American Muslims. The FBI, and a once honest Justice Department simply label CAIR as an unindicted co-conspirator with the terrorist organization, HAMAS.

Plus, in 2009, CAIR executive director Nihad Awad hailed Qaddafi as “the world Islamic popular leader," and then asked him for money. Apparently, CAIR is not too particular about which dogs it lies down with in order to get some fleas.

Qaddafi refused.

Sen. McCaskill (D-MO) Airplane Tax Bill to Include $80K in Additional Interest.

It's a Swiss-made Pilatus plane and has been quite troublesome for McCaskill as of late. Or rather her profligate misuse of tax payer dollars to fund her little outings on the machine, coupled with delinquent tax payments, are the source of the senator's troubles.

From the St. Louis Post Dispatch:

"According to the county Department of Revenue website, McCaskill's total bill is $319,541. The county calculations includes four years of interest -- $79,453 -- and penalties of about $6,250.

The final amount is still unofficial, pending confirmation by the State Tax Commission."

$319,541 dollars. That's a big chunk o' change, but McCaskill and her lawyer/developer husband have an estimated net worth of $15 million, so they might be able to scrape that together.

Maybe in her next political incarnation she can pay for her private trips out of her own pocket, instead of using a cushy expense account subsidized by 'Mr. & Mrs. Tax Payer.'

Oh, BTW: last month Sen. McCaskill, along with  Sen. Tom Coburn (R-Okla.) introduced a bill which would require all federal employees to be current in their taxes, or face termination. No word if the legislation exempts Congress from the requirements, but based on previous ruling class privileged behavior - Congress would probably be excluded from their own legislation.

Local Radio: 98.1 KUDL will Switch Formats to KMBZ-FM Talk/News

KUDL started broadcasting on the FM dial in Kansas City in 1965. Since 1978, it's been an 'easy listening' contemporary music station.

According to Bottom Line Communications, KUDL will soon become KMBZ-FM and simulcast with NewsRadio 980-AM KMBZ, which is an all News/Talk station. That link is over to your left.

The imminent  format change at KUDL is due to declining ratings.

It's a doctrine that's completely fair, and a teachable moment for NPR.

The inflammatory headline for this story posted on Left tilting Yahoo News reads "Apple, Steve Jobs under fire for approving app that claims to cure homosexuality."

Of course, the APP purports to do no such thing, and logically, cannot do such a thing. What the APP does is promote Exodus International, a Christian Ministry. And Liberals want it banned.

"The Exodus ministry seeks to promote the "ex-gay" movement—promulgating the testimony of people who claim to have been cured of homosexuality through Christ. The target audience for the smart-phone app, its makers say, are "homosexual strugglers." The idea is to teach gay people that they have a choice when it comes to their sexuality, a choice to choose "freedom from homosexuality through the power of Jesus."

Of course, providing a tech platform for a particular spiritual or ideological movement doesn't signify an endorsement of its point of view. At the same time, however, as Gawker's Ryan Tate noted during an earlier controversy over a gay-themed app, "every time Apple approves an app, it implies moral endorsement of the content of that app."

And since average Apple user is younger and more culturally tolerant of homosexuality, word of the Exodus app has sparked a fast-growing protest. As of this writing, more than 100,000 people have signed a Change.org petition calling on Apple to abolish it. What's more, some who've purchased it are somewhat baffled by it."

Obviously, because these wireless APPnuts are "more culturally tolerant," except, of course, when they're not, and are simply being aggressive religious bigots. Or opposing freedom of speech.

Mr. Jobs, I say let the wireless APPnuts mess their diapers. Any reasonable adult knows that if the APP is not viable in the market place, it will die a quiet digital death. Walsh that University of Wisconsin-Madison officials violated the First Amendment by refusing to fund certain events of Badger Catholic, a registered student group, while providing funding for the events of other student organizations.

The university refused funds from student activity fees because the student group’s events contained religious expression, including prayer, worship, and proselytization. The 7th Circuit affirmed lower court rulings that concluded the funding refusal amounted to unconstitutional discrimination based on viewpoint."

Agreed. Either deny equal access to funding for all groups, or allow equal access to funding.

"Separation of Church & State" is the oft misunderstood and misapplied cry for suppression of religious expression, and does not hold at what is ostensibly a free and open market place for ideas - the public university.

To slow down enough to get caught in Mercury’s gravitational field, Messenger fired its main thruster for 15 minutes. The burn slowed the spacecraft by 1,929 mph and used up 31 percent of its original fuel supply.

After finishing the burn, Messenger rotated to face the Earth by 9:45 p.m., and started transmitting data. Engineering and operations teams confirmed the maneuver went according to plan.

The event marks the end of a 6½-year journey for Messenger, which has made 12 laps around the solar system, two flybys past Earth, one past Venus and three past Mercury since launching in August 2004."

"If the Legislature decides to go back and re-act on these provisions, they have the right to do that. And we will see what happens," he said.

Uh, ok. But if the legislature re-acts to re-pass the law, will the fleebaggers re-flee?

Opportunity Scholarship Program, there were dozens of African-American and Latino children who came to support the program. The OSP, which provides low-income children with access to private schools, has been remarkably effective at increasing parental satisfaction and student graduation rates. As a result, it has been a lifeline to many D.C. children — 90 percent of whom are African-American and 100 percent of whom are low-income.

But at the hearing, students watched as members of the Congressional Black Caucus simply deferred to D.C. Delegate Eleanor Holmes Norton, a longtime opponent of school choice and the OSP, as she railed against the program.

Later, Delegate Norton, in her partisan zeal, obliquely referred to children who participate in the program as “lab rats” of Republicans, and argued that her constituents in D.C. only support the program because they’ll take any “free money” that can be “passed out” to them. It was a shameful and ignorant thing to say, especially considering that four years of parental focus groups on the Opportunity Scholarship Program shattered the myth that low-income parents cannot make informed decisions about where to send their children to school.

The children who attended this hearing were shocked to see their own congressional delegate and members of the Congressional Black Caucus speak against their program. After wards, one of the children even asked, “Why don’t the congressmen who look like us want us to go to better schools?”

Because democrats hate poor, mostly Black school children. It's the only answer. Or perhaps it's simply a matter of political payoff to union cronies.

Missouri House Approves Bill for "English Only" Driver's Exam

HR 167 now goes to the Missouri senate. This legislation seeks to eliminate the eleven printed language versions of the driver's exam, and the seven online language versions currently offered by Missouri, at an estimated savings to the tax payers of $53,000/ year.

The foreign languages currently catered to include Bosnian, Chinese, French, German, Greek, Italian, Japanese, Korean, Russian, Spanish and Vietnamese.

I guess our foreign guests who only speak Tagalog, Albanian, Thia, Burmese, Sanskrit, Arabic, Tajik, Dutch, Hebrew, French, Somali, Swedish, and Australian are simply out of luck. But, fortunately, the current provision to allow foreigners to hire interpreters at their own expense to take the license exam will remain.

Rep. Jerry Nolte, R-Gladstone, who sponsored the Missouri measure, said all drivers need to understand English to be able to read road signs and follow driving laws.

Rep. Mark Parkinson, R-St. Charles, said drivers should learn English as part of their transition to American culture. “Driving is a privilege, not a right,” Parkinson said. “Part of that privilege is to take the test in English.”

Opponents of the legislation trotted out the usual agitprop of "nativism, xenophobia, and bigotry," as if it's to be expected that one's chosen  host country should bend over backwards in order to accommodate whatever predilections are presented.

If signed into law, Missouri would join Oklahoma, Wyoming and Utah with an "English only" provision for taking the driver's license exam. Oklahoma pursued the English only law after an Iranian immigrant sued to have the exam administered in Farsi. Oklahoma was concerned that this could open a flood gate of lawsuits to force the tax payers to foot the bill for printing any number of different exams into the world's nearly 300 major languages.

The U.S. Department of Transportation Office of Civil Rights ruled in April 2010 that the Oklahoma case did not discriminate against the Iranian immigrant on the basis of national origin.

"McCaskill spokeswoman Maria Speiser conceded that the bill was inappropriate, and had no immediate explanation for how it had come to be submitted as an official expense.

"It appears that a mistake may have been made here," Speiser said. "Fortunately those payments have already been returned."

McCaskill "feels embarrassed by the situation, but ultimately is glad that it’s already been fixed," Speiser said, referring to the fact that McCaskill had reimbursed the treasury for the entire group of flights earlier this week."

"Feels embarrassed." But, apparently, not embarrassed enough to repay the $76,000 billed to the tax payers since 2007 until this story became public.
