*April 26, 1861: POTUS Abraham Lincoln(R) suspends habeas corpus via Executive Order

At the outbreak of the American Civil War in April 1861, Congress was not in session. Lincoln usurped unprecedented powers during an unprecedented time - the nation was at war with itself. Lincoln wanted to suppress insurrection and rebellion from secessionists of the Confederacy.

John Merryman, a state legislator from Baltimore, Maryland, was arrested for his attempt to hinder Union troop movements. He was imprisoned in Fort McHenry. A U.S. District Court judge issued a writ of habeas corpus for Merryman to appear before the court. The commander of Fort McHenry refused, and cited Lincoln's E.O. as his authority.

Merryman's lawyers appealed to the U.S. supreme court. Roger Taney, the chief justice of that court (and also the author of the infamous Dred Scott decision), issued a ruling that President Lincoln did not have the authority to suspend habeas corpus; only Congress could do that (Article I, section 9 of the United States Constitution). But Congress was not in session, so Lincoln ignored Taney, and privately threatened to toss the chief justice in prison.

In September 1861 the arrests continued, including a sitting member of Congress, one third of the Maryland General Assembly, and a prominent Baltimore newspaper editor. Lincoln was publicly demonized as a tyrant, despot, and dictator (hitler was unavailable at the moment) for his anti-constitutional edicts under the guise of 'war powers' to suppress the Confederate rebels. Privately, the first and only president of the Confederacy, Jefferson Davis(D), wrote in his dairy that he desired to have wartime powers like Lincoln. 

In February 1863, Congress passed the Habeas Corpus Suspension Act which gave its retro-active imprimatur to Lincoln's 'war powers' during the previous 2 years. Abraham Lincoln signed the bill into law on March 3, 1863. The American Civil War effectively ended on Apr 9, 1865 when Confederate Gen. Lee surrendered to Union Gen. Grant at Appomattox Courthouse, Virginia.

On Oct. 17, 2006, President George W. Bush signed a law suspending the right of habeas corpus to persons "determined by the United States" to be an "enemy combatant" in the Global War on Terror. Bush's action drew severe criticism (hitler was available), mainly for the law's failure to specifically designate who in the United States will determine who is and who is not an "enemy combatant."

Jonathan Turley, professor of constitutional law at George Washington University - and all around political gadfly for whichever cause du jur tickles his fancy - objected to Bush's support for the law (Military Commissions Act of 2006) and its suspension of writs of habeas corpus. He stated,
"What, really, a time of shame this is for the American system. What the Congress did and what the president signed today essentially revokes over 200 years of American principles and values."
...he said in total ignorance of Lincoln's actions 150 years prior.

"The August 11, 1993 episode appears to show Reade’s mother calling in and asking King about her daughter having “problems” with “a prominent senator.” Reade publicly accused former Vice President Joe Biden of sexually assaulting her in the early 1990’s last month."
The episode appears to have been deleted.


I think it's time for the Federal Election Commission to request an investigation into Google and CNN for unreported in-kind campaign contributions to Joe Biden(D).

Odd. I have it on good authority that lock down orders prohibit this type of non-essential activity. Thankfully, nobody in the family was injured, but property was damaged by bullets.
